About these terms These terms and conditions apply to all dealings that you, the customer may have with Art Downunder. Art Downunder is a business owned and operated by John Titlbach of Hervey Bay, Qld.
Art Downunder reserves the right to change, alter or update these Terms of Service at any time without notice.
Art Downunder only sells and ships within the Commonwealth of Australia.
Legal capacity to transact business with Art Downunder
Art Downunder only accepts orders from people over the age of eighteen and by accepting these terms you are acknowledging that you are over the age of eighteen
Placing your order
When you place your order and payment is processed by our billing company we are agreeing to supply you with the goods that you have ordered. At all times Art Downunder undertakes to maintain a sufficient level of stock to meet all orders.
However, if the item you have ordered is out of stock we will contact you by email to let you know when the items will be re-stocked and shipped to you.
Paying for your order
All payments to Art Downunder are processed by PayPal. PayPal accepts Visa, American Express and Mastercard. Alternatively you can also pay for your order with credits direct from your PayPal account.
At this time we are unable to accept any other credit cards other than those listed above. If PayPal is unable to process your transaction your order with Art Downunder will not be processed.
Fees and charges
The prices of all items displayed for sale on Art Downunder includes postage and GST. There are no hidden charges applied to your order by Art Downunder.
Any additional fees or charges levied by Paypal are completely beyond our control or knowledge.
The items that Art Downunder supply will be the items that you have ordered. All items stocked by Art Downunder have been created & painted by Art Downunder and free from damage.
If you find that when you receive the item it is not in good oder or has been damaged in transit then please contact us immediately.
All items will be well packed and shipped by Australia Post to the address indicated in your order. We are unable to ship any items to an address other than the one confirmed when you paid for the goods. Please allow seven to ten days for the items to reach you.
Refunds / Returns
If at any time it becomes necessary to give you a refund of the purchase price such refund will be made to the credit card or account from which the original payment was received. The refunds will be given less the postage within 7 days and the item needs to be in good condition.
Before you return the goods please contact Art Downunder to advise us of your problem.
We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
Art Downunder will not be liable for any delay in performing any of our obligations under these terms if the delay was caused by circumstances beyond our control.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Queensland and shall be subject to the non-exclusive jurisdiction of the courts of Queensland.
